  • By accessing and using Positivity Push ("Service"), you agree to be bound by these Terms of Service.
  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
  • If you do not agree with these terms, please do not use the Service.

2. Service Description

Positivity Push is a subscription-based AI coaching service delivered through WhatsApp that provides:

  • Daily positive affirmations and mindset coaching
  • Gratitude prompts and reflection exercises
  • Goal accountability check-ins and weekly progress reports
  • 24/7 AI-powered motivational support
  • Personalized coaching conversations based on your goals and activity

Our service is designed to support your personal growth, not replace professional mental health or medical care. Results may vary based on your engagement.

3. Subscription and Payment

We offer two plans:

  • 3-Month Plan: €28.99 (billed every 3 months)
  • 6-Month Plan: €34.99 (billed every 6 months)
  • Prices include VAT where applicable.
  • All payments are processed securely via our payment provider.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • You will receive a reminder notification before your subscription renews.
  • Renewals are charged to your original payment method unless updated.

4. Cancellation Policy

You may cancel your subscription at any time by:

  • Sending an email to support@positivitypush.com
  • Using the "Manage Subscription" link provided at signup
  • Your cancellation will take effect at the end of your current billing cycle.
  • Partial refunds are not provided for unused time after the 30-day guarantee period ends.

5. 30-Day Money-Back Guarantee

  • We want you to feel confident trying Positivity Push. If you're not satisfied within your first 30 days, email us at support@positivitypush.com and we'll issue a full refund—no questions asked.
  • Refunds are returned to your original payment method within 5–10 business days.

6. User Responsibilities

You agree to:

  • Provide accurate information during registration
  • Use the Service for personal, non-commercial purposes only
  • Not share your account or access with others
  • Not attempt to reverse-engineer, scrape, or duplicate any AI technology used
  • Not use the Service to transmit illegal, abusive, or harmful content
  • Treat our support team and AI coach with respect

7. Privacy and Data

  • Your privacy is important to us. All WhatsApp conversations are end-to-end encrypted.
  • We store only the minimum data necessary to operate the Service. For full details, see our Privacy Policy.
  • We never sell or share your data, and you can request deletion at any time.

8. Limitation of Liability

  • Positivity Push is intended for informational and motivational support. It is not a substitute for medical, psychological, or therapeutic care.
  • We are not liable for decisions made based on content from the Service.
  • To the maximum extent permitted by law, our total liability is limited to the amount you paid in subscription fees over the 12 months prior to the event giving rise to the claim.

9. Service Availability

  • We aim for reliable 24/7 access but cannot guarantee uninterrupted service.
  • We may temporarily suspend access for maintenance, upgrades, or due to external service interruptions (e.g. WhatsApp downtime).
  • We are not liable for service interruptions beyond our control.

10. Changes to Terms

  • We may update these Terms from time to time.
  • If we make material changes, we'll notify you via email or WhatsApp at least 30 days before changes take effect.
  • Continued use of the Service after that constitutes acceptance of the new Terms.

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of The Netherlands.
  • Any disputes arising out of or related to the Service shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, The Netherlands.
  • To the extent permitted by law, Positivity Push's total liability is capped at the subscription fees you paid in the 12 months preceding the claim.
